The Ethics Of Finding Answers To Dementia - Center Policy Brief Advances Protection For Individuals With Diminished Capacity

Not too many years into the future, approximately 70 million Baby Boomers will be age 65 or older. Some 44 states are projected to have Florida-like population demographics. Nearly one-third of this population will have significant dementia. Healthcare expenditures, already four times higher for a 65-year-old than a 40-year-old, will skyrocket by 25 percent.

Left unchecked, the social and financial costs will be devastating. To find answers, researchers must be able to study research subjects with diminished decision-making capacity. That is why the Center for Practical Bioethics, as part of its Science and Ethics Literacy Project, has published a policy brief to promote responsible research and protection of research subjects with diminished capacity. The work was funded by the Cloud L. Cray Foundation and the William T. Kemper Foundation.

Protecting Research Subjects with Diminished Capacity reports the outcomes of a national roundtable on this subject held in Kansas City, Missouri in May of 2006. The brief presents information on the types of research needed that require involvement of adults with diminished decision-making capacity, and addresses the ethical issues surrounding the use of such research subjects. Policy recommendations are also included to help shape federal regulations on this issue.

"There has never been a time when research addressing the issue of age-related dementia has been more needed or more important," says Myra Christopher, president and CEO of the Center for Practical Bioethics. "At the same time, there are concerns about whether we have the proper policy structure in place today to protect such human research subjects and to make sure they are not abused."

The policy brief outlines a number of interrelated ethical and legal concerns:

-- Current federal regulations do not provide guidelines to ensure studies involving adult subjects with diminished decision-making capacity will be on firm ethical grounds.

-- States vary widely in requirements for appointing surrogate decision-makers and in the levels of authority they give these representatives in research settings. 

-- Institutional Review Boards and researchers currently employ widely differing methods for determining the degree to which someone has the capacity to provide informed consent to participate in research. 

-- There are no clearly defined criteria for determining the types and levels of risk to which a proposed research study could expose participating adult subjects.

On July 31, a pre-published version of the policy brief was shared with the Secretary's Advisory Committee on Human Research Protections (SACHRP) of the US Department of Health and Human Services. Following panel presentations, the advisory committee voted to establish a committee to make recommendations to SACHRP for consideration by the Secretary of Health and Human Services. 

That was a huge step, according to Christopher. "Now it's in the political process and the committee is required to act," she says. "This has been a long time coming and I am delighted that the Center had the opportunity to make a significant contribution. It's a good example of what practical bioethics can and should do to impact public health policy."
