Real estate experts advise shopping thoroughly for the best mortgage deal. But often borrowers won't escape overages by studying advertised rates and fees or even calling lenders for estimates.
Puget Sound Bank president James Maxwell said his staff usually doesn't include overages in its estimate until part of the way through processing the loan.
Here's how he described his bank's lending procedure:
When a borrower calls to ask for a rate and fee quote, the loan officer who takes the call usually quotes the market rate and fee (the one set by investors) plus the standard profit margin of three-eighths of a percentage point for servicing the loan.
The borrower can "lock in" a rate and fee then, but nearly all opt to "float" until the deal closes, hoping rates will fall.
As the deal progresses, the borrower might check rates and fees periodically. Market rates during this time can fluctuate; they sometimes change at midday, but usually change just once a day.
When the borrower is ready to lock in a rate and fee, the loan officer gets the market rate that day. It's at this point that the overages are tacked on. They range from one-quarter to half a percentage point in upfront fees and/or an eighth of a percentage point in interest.
Thomas Lawler, a senior vice president with the Federal National Mortgage Association (Fannie Mae), advises borrowers to shop around and watch closely for lenders who not only "cushion"
market rates and fees, but entice borrowers with lower quotes then raise them later.
"That's wrong," he said. "It's not even bait-and-switch. It's worse."
Maxwell insisted Puget Sound does not "bait and switch" borrowers because the original quotes aren't firm estimates and the borrower can negotiate until the rate and fee are locked.
Borrowers don't always see it that way.
Stephen Hammil didn't feel he could negotiate because his deal involved a property trade that other lenders refused to consider. Gary Zelamsky's purchase was a condominium that only Puget Sound would finance. J. Michael Burry, a real-estate investor, was negotiating a loan by phone from his Virginia home and found it difficult to monitor his deal.
For other borrowers, the reasons for not negotiating are much less complicated. Many simply feel the pressure of financing deadlines and don't want to risk losing the hundreds of dollars they've paid for a credit report and appraisal.
Even Maxwell, when asked whether it's very hard for borrowers to switch lenders at the last minute, said, "I can't deny that element is present."
Peter G. Miller, a Washington, D.C.-area, real estate broker and author, said he's fascinated that borrowers plead for a loan instead of making lenders work for their business.
"It's very clear the public has no idea about how mortgage rates are established, what points are, what their rights are . . . to negotiate," he said.
"The issue is not that it's a terrible thing for lenders to try to maximize their profits. The issue is that it's a terrible thing for consumers to pay more out of ignorance."
